General Terms and Conditions (AGB) for Music Covers

 

1. Scope and Contractual Partner

 

1.1 These General Terms and Conditions (hereinafter referred to as "GTC") apply to all contracts concluded between [Your Shop Name], [Your Company Address], [Your Company Contact Information] (hereinafter referred to as "Seller") and the customer (hereinafter referred to as "Customer") through our online shop.

 

1.2 By placing an order, the Customer agrees to these GTC. Any deviations from these GTC require written confirmation from the Seller.

 

2. Offer and Conclusion of Contract

 

2.1 The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.

 

2.2 By clicking the "Buy" button, the Customer submits a binding order for the items in the shopping cart. The contract is concluded when the Seller confirms the order by email.

 

3. Prices and Payment

 

3.1 All prices are final prices and include the statutory VAT and other price components. Any additional shipping costs will be displayed separately during the ordering process.

4. Delivery and Shipping Conditions

 

4.1 Digital content is provided to the Customer via download link immediately after payment.

 

4.2 The delivery of physical products, if applicable, will be carried out to the address provided by the Customer.

 

5. Right of Withdrawal

 

5.1 The Customer has no right of withdrawal as the products are digital content that is individually customized for the Customer (Section 312g(2) No. 1 of the German Civil Code - BGB).

 

6. Retention of Title

 

6.1 The goods remain the property of the Seller until full payment has been received.

 

7. Warranty and Liability

 

7.1 Statutory warranty rights apply.

 

7.2 The Seller is liable without limitation for intent and gross negligence. In cases of slight negligence, the Seller is liable only for breach of essential contractual obligations (cardinal obligations), limited to foreseeable damage typical for the contract.

 

8. Data Protection

 

8.1 The Seller processes personal data of the Customer for appropriate purposes and according to legal regulations.

 

8.2 The Customer agrees to the collection, processing, and use of personal data. Detailed information is available in the Data Protection Declaration on our website.

 

9. Final Provisions

 

9.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

 

9.2 If any provision of these GTC is or becomes invalid, the validity of the remaining provisions shall not be affected.
